The short version: Be respectful. Your content belongs to you. Don't misuse the platform. A project link is not a password — anyone who has it can open the project, so share it only with people you mean to reach. Printed books are made to order, so they aren't refundable, but we reprint anything we got wrong. We provide this service as-is and cannot guarantee it will be error-free. By using Memory Booked you agree to these terms.
By accessing or using Memory Booked (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Memory Booked. Please read them carefully. Your use of the Service constitutes your acceptance of these Terms and our Privacy Policy, which is incorporated herein by reference.
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are 13 years of age or older. If you are between 13 and 18, you represent that you have your parent or guardian's consent to use the Service.
The Service is intended for personal, non-commercial use. If you wish to use the Service for commercial purposes, including white-labelling or business accounts, please contact us to discuss available arrangements.
To access certain features of the Service — including contributing a memory to any project — you must create an account and verify your email address. You agree to:
We reserve the right to disable or terminate accounts that violate these Terms or that have been inactive for an extended period, following reasonable notice where practicable.
Your content belongs to you. You retain full ownership of all memories, photos, captions, and other content you submit to the Service ("User Content"). We do not claim ownership of your User Content.
By submitting User Content, you grant Memory Booked a limited, non-exclusive, royalty-free licence to store, display, reproduce, and transmit your User Content solely as necessary to provide the Service — for example, to display your submission to the project organiser, to compile it into a photobook, and to send it to a print partner when a book is ordered.
This licence is limited to operating the Service. We will never use your User Content for advertising, sell it to third parties, or use it to train machine learning models.

We reserve the right to remove any User Content and suspend or terminate any account that violates these rules, without prior notice.
Project organisers are responsible for the projects they create, including managing contributor access, reviewing submissions, and ensuring that the project's purpose and content comply with these Terms.
Contributors submit memories and photos at their own discretion. Contributing requires an account with a verified email address. By default, every submission is held for review and must be approved by the project organiser before it appears in the project or the printed book. An organiser may instead set a project to publish submissions automatically, in which case a memory appears on the project page as soon as it is submitted; the organiser can still remove it afterwards. Memory Booked does not guarantee that submitted content will be approved or included in a final photobook. When submitting, you may mark a memory as private, in which case it is included in the printed book but is not displayed on the project page.
Project visibility. Organisers choose one of three settings for each project:
Please read the following carefully, because it describes a real limit of the Service. Project links are not passwords. A project page can be opened by anyone holding its link, and links can be forwarded beyond the people an organiser intended to reach. Organisers should share project links only with people they intend to reach, and should treat any link they post publicly as public. An organiser may replace a project's link at any time from the project settings; the previous link stops working immediately, and anyone using it is told the link was replaced. We make reasonable technical efforts to keep unlisted projects out of our public listings, search results, and feeds, but we cannot guarantee the privacy of content in any project whose link has been distributed.
Gifts made through the platform are voluntary contributions toward printing costs and are not refundable. If you believe a gift was made in error, contact [email protected] and we will review the circumstances, but we are under no obligation to refund a completed gift.
Payments for printed photobooks are processed by Stripe, a third-party payment processor. By making a payment, you also agree to Stripe's terms of service. We do not store your full payment card details.
Refunds. Every photobook is custom-printed on demand from content you have reviewed and approved, and cannot be resold. For that reason we do not issue refunds on printed orders. Before a book is sent to print you must complete a final review and approval step, in which you confirm the text, photo quality, cropping, page order, cover and contributor credits are as you want them.
If a book arrives with a defect caused by a printing, binding or manufacturing error on our side, or is damaged in transit, we will reprint and reship it at no charge. Our Return Policy sets out in full what counts as a printer error, what is not covered, and how to make a claim, and it governs printed orders in the event of any inconsistency with this section.
Digital copies. Downloading your book as a PDF is free, so no payment or refund arises in connection with it.

The Memory Booked name, logo, website design, software, and all other content provided by Memory Booked (excluding User Content) are owned by or licensed to Memory Booked and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, modify, distribute, or create derivative works based on any part of the Service without our prior written permission, except as permitted by applicable law or as expressly authorised in these Terms.

The Service is provided "as is" and "as available," without warranty of any kind. To the fullest extent permitted by law, Memory Booked disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
You use the Service at your own risk. We strongly recommend keeping copies of any memories, photos, or content you submit, as we cannot guarantee against data loss.
To the fullest extent permitted by applicable law, Memory Booked shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.
In no event shall Memory Booked's total liability to you for all claims arising out of or relating to the Service exceed the greater of (a) the total amount you paid to Memory Booked in the twelve months preceding the claim, or (b) one hundred US dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. If you reside in such a jurisdiction, some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Memory Booked and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or if required by law.
You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service ceases immediately. Sections 4 (User Content and Ownership), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law) survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Salt Lake City, Utah, or remotely if agreed by both parties. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver: You agree that any arbitration will be conducted on an individual basis only, and not as a class, consolidated, or representative action.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration.
We may revise these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email at least 30 days before the new terms take effect.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service before the effective date.
